In construction contracts, a
seller of goods who has made a nonconforming tender of goods (i.e.,
steel, flooring materials, furnishings and equipment that does not meet
contract specifications) can avoid a major breach of contract by curing
the defect within the contract time. Under the Uniform Commercial Code,
to cure, the seller must notify the buyer of his intention to supply the
conforming goods, and he must deliver the goods before the contract
expires.
